Terms of Service

1. Description of Service

Decyde is an AI visibility intelligence platform that analyzes how artificial intelligence models (such as ChatGPT, Perplexity, Gemini, and Google AI Overviews) reference, recommend, and cite brands in response to user queries.

The Service provides:

• Free AI visibility audits that generate a visibility score, platform breakdown, key findings, and recommendations based on AI model queries.
• Pro subscription features (paid) that include continuous monitoring, citation source mapping, weekly action playbooks, and historical score tracking.

2. Accounts and Authentication

To access certain features of the Service, you must provide a valid email address and authenticate via our magic link login system. You are responsible for maintaining the security of your email account and any authentication tokens associated with your Decyde account.

You agree to provide accurate and complete information when creating an account or submitting an audit. You may not impersonate another person or entity or use a false email address.

3. Free and Pro Plans

Free Plan

The free plan allows you to run AI visibility audits subject to usage limits we may set from time to time (currently one audit per month). Free plan users receive access to a limited view of the dashboard including their score, platform breakdown, and key findings.

We reserve the right to modify the features and limits of the free plan at any time.

Pro Plan

The Pro plan is a paid subscription at the price displayed on the Service at the time of purchase (currently $99 USD per month). Pro features include continuous weekly monitoring, full citation intelligence, AEO action playbooks, and historical score tracking.

4. Payment and Billing

All payments are processed by Stripe (Stripe, Inc.). Stripe handles payment processing, invoicing, and PCI compliance.

• Subscriptions are billed monthly in advance.
• Your subscription renews automatically each month unless canceled.
• All fees are quoted in US Dollars (USD) and may be subject to applicable taxes.
• Refund requests should be directed to support@decyde.co.uk. Refunds are handled on a case-by-case basis at our discretion.

5. Cancellation

You may cancel your Pro subscription at any time through the dashboard Settings page or through Stripe’s customer portal. Upon cancellation:

• Your Pro features remain active until the end of your current billing period.
• After the billing period ends, your account reverts to the free plan.
• Your audit history and most recent score remain accessible on the free plan.
• We do not provide prorated refunds for partial billing periods.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Submit false, misleading, or fraudulent information through the audit form.
• Attempt to gain unauthorized access to the Service, other user accounts, or our systems.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated tools (bots, scrapers, etc.) to access the Service beyond normal use, except through our official API if one is provided.
• Resell, redistribute, or sublicense access to the Service without our written permission.
• Use the Service to harass, defame, or harm any person or entity.
• Interfere with or disrupt the Service or the servers and networks connected to it.

We reserve the right to suspend or terminate your access to the Service if you violate these Terms.

7. Intellectual Property

The Service, including its design, code, text, graphics, logos, and all content generated by the platform, is owned by Decyde and protected by applicable intellectual property laws.

Your Data

You retain ownership of the information you provide to the Service (brand name, competitor name, website URL, etc.). By submitting information to the Service, you grant us a non-exclusive, worldwide license to use that information to provide and improve the Service.

Generated Reports and Recommendations

Audit reports, scores, recommendations, and action plans generated by the Service are provided for your use. You may use, share, and act on these outputs for your business purposes. However, the underlying algorithms, prompts, and methodology used to generate these outputs remain our intellectual property.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Specifically:

• AI-generated data is not guaranteed to be accurate. Decyde queries third-party AI models and presents their responses. We do not control how these AI models generate answers, what sources they cite, or how they rank brands. AI model responses may change over time, vary between sessions, and contain errors.
• Scores are indicative, not definitive. AI visibility scores are calculated using our proprietary heuristic methodology and are intended to provide directional insight. They should not be treated as absolute measurements of market position or brand value.
• Recommendations are suggestions, not guarantees. Action plans and recommendations are generated based on AI analysis and should be evaluated by qualified professionals before implementation. We do not guarantee that following our recommendations will result in improved AI visibility or business outcomes.
• Third-party AI platforms may change. The behavior, availability, and policies of third-party AI platforms (ChatGPT, Perplexity, Gemini, Google AI Overviews) are outside our control. Changes to these platforms may affect the accuracy, availability, or relevance of our Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DECYDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These limitations apply regardless of the legal theory on which the claim is based, including negligence, breach of contract, or strict liability.

10. Indemnification

You agree to indemnify and hold harmless Decyde, its officers, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

12. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you via email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Termination

We may terminate or suspend your access to the Service at our discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to the Service, other users, or third parties.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including Sections 7 through 10.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Decyde regarding the Service and supersede all prior agreements and understandings.
